This online marketplace that allows users to buy items.
Blessed Edward Oldcorne Catholic College has possession of anything listed and sold through the site.
The suggested pricing of items, are set by Blessed Edward Oldcorne Catholic College. All queries relating to costs should be directed to the site member listing the item in question.
Should any disputes arise, we will try and facilitate the resolution of such disputes. It is the responsibility of parties involved in site transactions (e.g. listing, buying, selling, ) to arrange payment for all items directly with each other. For guidance on ensuring you make safe and secure financial transactions.
You agree that we can commence supplying our Services to you as soon as you accept this User agreement (by agreeing to our Terms and Conditions). You can cancel this User agreement under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Purchase conditions
When buying an item, you (the user) are responsible for:
- reading the details relating to the item before making a commitment to buy or donate
- liaising with the seller (and vice versa) regarding payment for the item and agreeing delivery details.
Site content
You agree not to remove any copyrighted, trademarked, proprietary or identification markings relating to the products and in their marketing, or create any derivative works based on that data
Data protection and privacy
Please ensure you read and comply with our company’s Privacy Policy.
- You (the user) and School Resources Exchange shall process personal data received under and/or in connection with this User Agreement each as a separate and independent controller. In no event will School Resources Exchange and you process personal data under and/or in connection with this User Agreement as joint controllers or in a controller-to-processor relationship. As such separate and independent controllers, you shall be individually and separately responsible for complying with the obligations that apply to you as a controller under applicable data protection laws.
- You (the user) shall comply with your obligations under applicable data protection laws (including but not limited to Regulation (EU) 2016/679 (EU General Data Protection Regulation “GDPR”) and supplementing EU and local data protection laws. This includes, but is not limited to, the obligation to provide appropriate safeguards for the transfer of personal data to a third country or an international organisation. You shall process personal data received from School Resources Exchange exclusively for the purpose(s) you received the personal data under and/or in connection with this User Agreement. You shall erase the personal data received under this User Agreement immediately after the respective purpose(s) has/have been fulfilled. Any further processing of the personal data is not permitted except when legally required (e.g. if a retention obligation applies).
- Failure to abide by the aforementioned obligations may result in disciplinary action up to and including account suspension.
Additional Terms
Money-back guarantees
We do not provide an e-commerce payment platform for financial transactions between users and so we cannot accept responsibility for financial transactions between parties. The responsibility for financial transactions between parties on the site lies with the parties and so we do not provide any money-back guarantees for any failed transactions.
Returns
If a user has received an item and they are not happy with it, we suggest the following course of action:
- Contact the seller (other user) to discuss the issue in the first instance.
- If a resolution cannot be found and it is proven that an item is not as described, we propose that:
- The user (buyer) should return the item to the seller
- The cost of returning the item is the responsibility of the seller
Liability.
We are not liable to you in contract, tort (including negligence) or otherwise for any business or personal losses arising directly or indirectly from:
- Your use or inability to use our Services.
- Viruses or other malicious software obtained by accessing or linking to your services.
- Glitches, bugs, errors or inaccuracies of any kind in our Services.
- Damage to your hardware device from the use of Blessed Edward Oldcorne Catholic College
- The content, actions or inactions of third parties.
Compensation
You will compensate us in full for any losses or costs, including reasonable legal fees, we incur arising out of any breach by you of this User Agreement, your improper use of our Services or your breach of any law or the rights of a third party.
